• The "service provider" is BetterLink Pty. Ltd. ACN 075 486 618
• The "account" means the customers rights under this agreement with the service provider.
• The "service" means interactive dial-up access to the service provider network including computer resources, disk storage and computer communication facilities.
• The "customer" means any person or entity identified as such on the agreement form.
• The "user" is defined as the customer or any person Authorised by the customer to access the service.
• "Hacking" means unauthorized entry by any means into another computer to observe data contained therein, to copy or damage information on that computer or interfere with the use, operation or efficiency of that computer
  
  

Illegal Use / Pornography

• The customer shall not use, nor permit any other party to use the service with any matter of an illegal nature.
• The customer agrees not to upload into the provider any virus worm or other program known or suspected to have a detrimental effect upon any computer or virtual server.
• The customer agrees not to Hack.
• The customer agrees not to store hacking or related material on or through the gateway provided by BetterLink.
• The customer agrees not to store on BetterLink, or any associated computer, nor allow to electronically pass through BetterLink any data which would contravene Australian Laws relating to production and distribution of pornographic material.
• The customer agrees not to include links to pornographic data at other computer sites in the User’s World Wide Web pages.

Copyright

• The customer agrees not to use the service to reproduce, transmit, store in a retrieval system, or translate into any language or computer language any material subject to copyright where the customer does not own or have license to use such material. The customer also agree not to establish any hypertext links to material which promotes or facilitates copyright infringement.

Charges

• The charges for use of the service are as published on BetterLink's pricing plan and a copy is made available to the user upon application for the service.
  The service provider reserves the right to alter the charges from time to time. Any prepayment for access to the service is non refundable.

Disclaimer

• BetterLink Pty. Ltd. and associated companies shall have no liability or responsibility to customers or any other person or entity with respect to any liability, loss or damage caused directly or indirectly by the service offered, including but not limited to any interruption of service, loss of business or anticipated income or profit or damage whether consequential or not, resulting from the use of the service.
  The parties acknowledge that the law applicable to this Agreement is the law of the State of Victoria, Australia.
